a. Prices are subject to change based on demand.

b. I reserve the right to decline any commission for any reason.

a. All commissions under $100 must be paid in full, upfront. For larger commissions, a payment plan may be implemented

_{i. All payment plans must be agreed to in writing prior to the commission.}

_{ii. Failure to follow payment plan will result in non-deliver of the commission.}

b. All payments must be made through VGen or Ko-fi.

c. Please do not send payment before your slot is confirmed and payment is requested.

d. Chargebacks or payment disputes made without prior discussion will result in a public ban and loss of all rights to the commissioned artwork. I will also submit evidence to the payment platform to counter the dispute.

a. Minor changes are free unless otherwise specified.

b. Revision to the final piece due to client error or change of mind will incur an additional fee, provided in writing.

c. If your reference is unclear or incomplete, revision requests may incur additional changes.

d. Changes requested due to an error or misunderstanding on my part will be made free of charge.

e. Work-in-progress (WIP) approvals are required to continue. If the client does not respond to a WIP update within 14 days, the commission may be delayed or considered abandoned depending on the situation.

a. Completion time will vary depending on my workload, health, and other factors.

b. I will provide an estimated time frame for completion.

c. You will receive periodic updates and may request feedback at stages in my iterative artistic development.

d. My Trello and VGen page will reflect the commission’s current status.

e. You will receive a full-resolution digital image upon completion. No physical item will be shipped.

a. Personal Use:

_{i. You may share the commissioned artwork online with credit to me.}

_{ii. You may use the artwork for any non-commercial icons, backgrounds, character references, etc}

b. Commercial Use:

_{i. Commercial use rights must be purchased separately.}

_{ii. Commercial usage includes: prints, merchandise, branding, etc.}

_{iii. Proper credit must always be given to me as the artist.}

c. Prohibited Use:

_{i. You may not use the artwork for hate speech, discriminatory, or harmful purposes}

_{ii. You may not use the artwork in a manner that reflects negatively on others or on me.}

_{iii. I reserve the right to reject any use I find inappropriate or harmful, including racism, sexism, or other obscene purposes.}

_{iv. You may not use, upload, or mint the commissioned artwork in or for any blockchain technologies (including but not limited to NFTs, cryptocurrencies, or blockchain games.)}

_{v. You may not use the artwork to train or generate data for artificial intelligence (AI) models, image generators, or similar tools.}

a. I, Hyrax Tefora (the artist):

_{i. I reserve the right to cancel and refund the commission at any time.}

_{ii. I retain full copyright over the commissioned artwork.}

_{iii. I will not claim ownership of the characters or intellectual property you provide.}

_{iv. I reserve the right to post the commissioned artwork online for marketing and showcase purposes.}

b. Client Rights (You):

_{i. You retain the right to your intellectual property (e.g. your original character designs).}

_{ii. You may report the artwork with credit to the artist.}

_{iii. You may not alter, resell, or profit from the artwork without explicit permission or commercial rights.}

_{iv. Alterations without my consent are not permitted without my express written consent.}

_{v. Selling an Adoptable that includes my art is permitted only if discussed prior to final delivery, or otherwise amended afterwards.}

c. Copyright Infringement Includes (but is not limited to):

_{i. Using the artwork commercially without a license.}

_{ii. Claiming the artwork as your own.}

_{iii. Altering the artwork without permission.}

a. Full refunds will be issued if I am unable to start the commission.

b. If you cancel before I begin, you are entitled to a full refund.

c. If you cancel after I’ve started, a partial refund will be issued on the amount of work completed. (E.g. If 40% is complete, you will receive a 60% refund, regardless of acceptance of the partial product.)

d. No refunds will be given once the piece is completed.

e. I reserve the right to terminate the project at any time for any reason. In such cases, a refund will be issued based on the level of completion.

a. All communication should be conducted through VGen, unless specifically annotated otherwise.

b. If I have not responded to a communication within a week, you may message me via the other platforms listed in my bio.

c. I record all conversations for documentation and our mutual safety.

d. If you are rude, hateful, or act inappropriately, your commission will be cancelled immediately, you will be refunded appropriately, the artwork may be discarded, and you will be banned from my future commissions.

e. If the client fails to provide necessary feedback or communication for more than 30 days without prior notice, the commission will be considered abandoned, and refund may be applied as appropriate to work completed.

a. Breach of any of the above terms will result in loss of right to the commissioned artwork.

b. I reserve the right to profit from or redistribute the artwork if a violation occurs.

c. Terms may be modified if discussed with me prior to commissioning.

d. Clients who violate these terms or engage in abusive behavior may be blacklisted, which means they are permanently banned from commissioning me again.
